Photography Terms of Use
Images available in the Stanislaus State Public Photo Gallery (“Image” or “Images”) are copyrighted by California State University, Stanislaus (Stanislaus State) on behalf of the California State University Board of Trustees. By downloading a digital copy of any Image, you have acquired a license to use the Image in accordance with the terms and conditions included herein. In acquiring this Image, you agree to use it solely as provided in these terms and conditions and to comply with all terms and conditions below.
You may not:
- Transfer, re-sell, distribute or sub-license the rights to the Image(s).
- Reverse engineer, decompile or disassemble any part of the Image(s).
- Use the Image(s) in any way that could be considered defamatory, libelous, pornographic, obscene, immoral or fraudulent. Not to be used in negative ads.
- Use Image(s) in any manner to indicate or imply endorsement of any commercial product or service.
Stanislaus State grants you a non-exclusive, royalty-free license solely to use the Image for non-commercial purposes. Images shall not be used in any manner to indicate or imply endorsement of any commercial product or service on behalf of Stanislaus State.
You agree that you will not use the name or trademark of Stanislaus State or the name of any employees in any publicity or advertising without the prior written consent of Stanislaus State.
You acknowledge you are not acquiring any ownership rights in the Image, and that Stanislaus State retains all right, title and interest in and to the Image not expressly granted under these terms and conditions, including, without limitation, all copyrights. Images shall not be altered, reproduced or otherwise distributed without the prior written consent of Stanislaus State.
You agree to give appropriate credit to Stanislaus and to the photographer(s), when listed, as a condition of your use of the Image as permitted herein.
ALL IMAGES ARE PROVIDED “AS IS” AND STANISLAUS STATE DOES NOT MAKE ANY WARRANTIES REGARDING THE IMAGES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. STANISLAUS STATE MAKES NO REPRESENTATION OR WARRANTY THAT THE USE OF THE IMAGES WILL NOT INFRINGE ANY INTELLECTUAL PROPERTY RIGHT. STANISLAUS STATE IS NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
You agree to indemnify and hold harmless Stanislaus State, the California State University Board of Trustees, and their respective officers, employees and students from any claims, damages, fines, losses or expenses incurred by any of them arising from or in connection with your use of the Image.
These terms and conditions shall be governed by the laws of the State of California without regard to any conflict of laws principles or provisions.
By acquiring or downloading the Image from the Stanislaus State Public Photo Gallery, you acknowledge and agree to abide by these terms.
